What Is A Diversion?

How A Diversion Works

A Diversion Agreement is a common way of resolving many traffic and

criminal charges, especially in Kansas. Charges as varied as Traffic

Tickets, Driving While Suspended, DUI, and Drug Possession,

including certain felonies, can be eligible for diversion.

What is a diversion? Basically, a diversion is a legal contract negotiated by your attorney with the prosecutor’s office. A Diversion Agreement is typically from 6 to 12 months in duration depending upon the charge. The purpose of a diversion is to allow individuals who are first-time offenders (or who at least have relatively clean records) to keep a charge and conviction off of their record.

The person signing the diversion agrees to assume certain obligations. A diversion agreement will require that the person signing not have any new, serious violations of the law, pay a diversion fee, and sometimes attend various classes or fulfill other requirements depending on the nature of the charge(s).

 

A diversion is a form of probation and can be either supervised or unsupervised. If the diversion is successfully completed, the charge(s) which have been diverted will be dismissed by the court and will not result in a conviction.
