Driving with a Suspended (DWS) or Revoked (DWR) driver’s license is a criminal offense in Missouri and Kansas. Conviction for DWS or DWR can result in possible jail time and can cause your driver’s license to become suspended or revoked for even longer.

How Did I Get Suspended?

A driver’s license can become suspended for many reasons. At Traffic Law Central, our first priority is to determine what is causing your license to be suspended or revoked. We investigate this by thoroughly examining your driving record.

Typical Reasons For A Suspended License Include:

• In Missouri, the Department of Revenue may suspend your driver’s license for having too many points.

 

• In Kansas, your license can become suspended for having too many traffic violations or you can be placed on a Habitual Traffic Offender Suspension.

 

Having unpaid tickets or traffic warrants will result in your license becoming suspended. In order to become reinstated, these outstanding tickets must be resolved by obtaining proof of compliance.

A license can also become suspended or revoked as a result of conviction for a DUI or DWI (or administrative suspension for a breath test failure or refusal). In Missouri, becoming reinstated after a DWI can require payment of a reinstatement fee, filing proof of liability insurance (SR-22) and completion of the SATOP program. Alcohol convictions in Missouri can even result in 5 or 10-year license revocations. In Kansas, a DUI conviction or administrative license suspension can require that you install an ignition interlock device on your vehicle before your license can be reinstated. While a hardship license can sometimes be obtained in Missouri, even for alcohol-related suspensions, Kansas does not offer a hardship license under any circumstances.

 

• Involvement in an auto accident without proof of insurance or Failing To Report An Accident (Hit & Run) can also cause a license to be suspended.

 

• In Missouri, a license can become suspended due to non-payment of court-ordered child support.

 

• Drivers under 21 can lose their license if they are convicted of any alcohol offense including Minor In Possession (MIP).

 

• Failure to Maintain Insurance when ordered to do so as a condition of reinstatement, non-payment of reinstatement fees or a conviction for the charge of No Proof of Insurance can also result in license suspension or revocation.

Penalties For Driving While Suspended Or Revoked

In Missouri, conviction for DWS or DWR can be punishable by up to 180 days in custody or more if you have been previously convicted of the same offense in the past. Driving While Suspended or Revoked is also a 12-point violation. Conviction of a 12-point offense triggers an additional 12-month suspension or revocation of a Missouri driver’s license.

 

In Kansas, DWS or DWR can also carry mandatory jail time and conviction of DWS or DWR will result in a driver’s license suspension of between 90 days and three years depending upon your previous driving history.
