Drunk driving laws in Kansas are very strict. First-time offenders charged with Driving Under the Influence (DUI) of alcohol or drugs can face jail time and there is often mandatory jail time for second-time offenses. Do You Qualify For Diversion Or Probation?

Kansas law does not allow a charge of Driving Under the Influence (DUI) to be amended or reduced to a lesser offense. In effect, it is illegal for prosecutors in Kansas to plea bargain on a DUI charge except in terms of the penalties.

 

Fortunately, there are options for resolving DUI charges in ways which do not result in conviction or mandatory jail time. Some first-time offenders may qualify for a diversion program. A diversion is a legal contract negotiated by your attorney with the prosecutor. Diversion agreements are generally for 12 months and can result in the dismissal of a DUI charge if successfully completed. We have successfully negotiated diversion agreements for many of our clients as well as guiding them through all aspects of the diversion process.

 

Many individuals however, do not qualify for diversion programs – Commercial Driver’s License holders, individuals charged with DUI in the context of an Auto Accident, those with very high Blood Alcohol Content (BAC) test results or those who have past convictions for DUI or any other serious misdemeanor or felony offenses – can be ineligible for DUI diversion programs. Despite these challenges, we fight for our clients and are often able to overcome the objections of prosecutors and succeed in having our clients DUI charges diverted.
