Assault and Battery

An Arrest Is NOT A Conviction

Assault and Battery are often charged together, even though they are actually separate offenses. Assault does not necessarily involve any physical contact.

 

All that is required for a charge of Assault is violent or aggressive words or conduct which would cause a person to fear for their personal safety. In other words, any intentional display of force directed towards someone else, including aggressive words or gestures, could cause a person to be charged with assault.

Battery involves some type of physical contact, usually bodily injury or unwanted touching such as hitting, slapping or grabbing. For example, most Domestic Violence cases are actually charged as domestic battery. Like Assault, Simple Battery is generally charged as a misdemeanor. Aggravated Battery, which generally involves serious bodily injury, is charged as a felony. Since Battery always includes Assault, a person charged with Battery is typically cited for both offenses. Because Battery is classified as a “crime of violence,” there’s also a real possibility of  jail time.

Simple Assault is generally charged as a misdemeanor. Aggravated Assault is more serious and is charged as a felony. It typically involves threats with a deadly weapon or attempts to cause serious injury. In either case, however, an assault charge can carry mandatory jail time.
