Penalties for Commercial Driver Offenses

A commercial driver convicted of DUI (Kansas) or DWI (Missouri) is subject to automatic suspension of the CDL for one year, with no diversion or suspended sentence available. The threshold for drunk driving is only .04 BAC for CDL holders — even if you were driving your own vehicle at the time. A second DUI/DWI can cost you your CDL for life. The only option may be to take your case to court, and Mr. Bukaty is an experienced trial lawyer.

• In Missouri, a truck driver convicted of two serious traffic offenses (including speeding 15+ mph over the limit) can be subject to a CDL disqualification period of several months.
• Accumulating too many traffic violations (Kansas) or too many points (Missouri) can result in driver's license suspension, applying to your CDL as well.
